Judgment books

Sub-series forms part of <i>Circuit records at Annapolis Royal</i> series and consists of books used to record judgments awarded by the court in civil actions. Generally the books record, for each award, the parties to the cause, their lawyers, the nature of the claim, and the amount of the award, including any costs awarded. In many instances, the judgments are default judgments awarded when the defendant did not enter an appearance, or response, to the initial writ. Case numbers, settlements and information concerning executions and attachments are also recorded, although their completeness is unknown. Each book is indexed.

Rules of the Supreme Court

Sub-series forms part of Circuit records at Sydney and consists of two volumes recording rules of the supreme court. The dated volume is a handwritten copy of what is also found as RG 1 Volume 143 in the Halifax records of the Supreme Court. These rules would appear to date primarily from the time when Cape Breton was a separate jurisdiction and during which the Halifax rules would not appear to have been directly applicable. The second, undated, volume belonged to C.L. Leonard, who was prothonotary when Cape Breton was a separate colony and who continued to act after reannexation.

Index to inquests filed with prothonotary's office

Sub-series forms part of Circuit records at Sydney and consists of two volumes indexing inquests filed with the prothonotary at the Sydney Court House. The index gives the date of death, date of the inquest and the date the report was filed. The inquests themselves are not part of the holdings of Nova Scotia Archives and Records Management.

Case files

Subseries forms part of Digby County circuit records series and consists of case files relating to civil actions and matters, as well as criminal prosecutions. Case files contain summonses, subpoenas, affidavits, briefs, exhibits (documentary evidence), pleadings, informations (charges), indictments, appeals, motions, orders, rulings, transcripts of testimony, motion orders, rulings, verdicts, and other materials. Matters include the Incompetent Persons Act, guardianship, and the disposition of the real estate of minors. This sub-series is arranged by type of case files and then in chronological order within each type: civil cases; civil and criminal cases; criminal cases; and matters.

Docket books

Sub-series forms part of Digby County circuit records and consists of books of entry that provide a calendar of causes to be heard by the court. Entry books provide the names of plaintiff and defendant, their solicitors, the nature of the action, and how the action was disposed of by the court (including the amount of the judgment or damages awarded). Entry books for 1888-1969 include minutes of cases (1938-1969), but no entries exist for 1920-1935. Entry book for 1940-1972 contains a nominal index.

Jury lists

Subseries forms part of Guysborough County circuit records series and consists of lists of persons qualified to serve as grand and petit jurors.

Judgment books

Subseries forms part of Circuit records at Windsor series and consists of judgment books that record decisions of the court in civil actions with regard to the awarding of judgments. In jury cases the question put to the jury are recorded. Information given includes names of the parties in the lawsuit, date of judgment, and amount of damages and/or costs awarded. Some satisfactions are recorded. Most volumes contain a nominal index of plaintiffs and defendants by the first letter of their surnames. The volumes are arranged in chronological order and some overlap slightly. Although the records in this series start in 1897 the numbering / naming of the volumes by the records creator suggest earlier volumes existed and may have been destroyed in the great Windsor first of 1897.

Execution and attachment books

Subseries forms part of Kings County circuit records series and consists of volumes used by the sheriff to record the execution of judgments and the proceeds from the sale of items seized in fulfilment of judgments. These books record the cause number, parties, legal counsel, amount sought and costs, dates writs were served and returned, and whether property was seized or payment made to satisfy the judgment.

Proceedings books

Subseries forms part of Kings County circuit records series and consists of volumes used by the court clerk to record court proceedings. The volume covering the years 1786 to 1802 records the proceedings of the Supreme Court, the swearing in of the Grand Jury, their actions and the disposition of cases before the court. The volumes covering the years 1947 to 1957 contain notes made during proceedings and may include county, supreme, divorce or matters heard in chambers. These books are not particularly consistent about what is recorded and range from detailed minutes of evidence to lists of cases on the docket. Some jury lists were recorded in the more recent books.

Case files

Subseries forms part of Circuit records at Pictou series and consists of case files containing summonses, subpoenas, affidavits, depositions, briefs, exhibits, pleadings, informations (charges), indictments, appeals, motions, orders, decisions, verdicts, and transcripts of proceedings, and files relating to the appointment of guardians. While containing such a variety of documents as a group, individually the files overwhelmingly reflect civil suits for the collection of debts and usually only contain information substantiating the debt. Few criminal case files exist. From 1884 onwards the cause books serve as an index by plaintiff to case numbers. Prior to 1884 civil cases may be identified in the docket books and cause books. Judgment books contain indexes by plaintiff; however, not all actions resulted in entries in the judgment books. No indexes to criminal cases appear to exist. Files are arranged chronologically. Starting in the 1880s case numbers and docket numbers indicate this order. Prior to this time the cases are arranged within each year alphabetically by plaintiff.
